Terms of Service

The Terms of Service of PhoneTracker247 define the legal framework for using our phone tracking and monitoring solutions. By accessing or installing the app, users agree to comply with all applicable data protection laws such as GDPR, CCPA, and PDPA. These terms explain the rights and responsibilities of users, businesses, and PhoneTracker247 regarding data security, consent, acceptable use, and liability limitations. Our mission is to ensure transparency, trust, and legal compliance in every aspect of mobile monitoring — whether for family safety, employee management, or lost-device recovery.

1) Acceptance of These Terms

By accessing, installing, creating an account, or using our websites, software, or services (collectively, the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

2) Definitions

  • “User”: the person or entity that creates an account and controls use of the Service.

  • “Monitored Device”: a device on which the PT247 software/agent is installed or that is connected to the Service.

  • “Device Owner/Authorized User”: the person who owns the device or has legal authority to permit monitoring.

  • “Content”: any data submitted to or generated by the Service, including reports and device signals.

3) Eligibility

You must be at least 18 (or the age of majority where you live) to create an account. If you are a parent/guardian using the Service for a minor, you represent you are the minor’s legal guardian or otherwise have lawful authority.

4) Lawful Use, Notice, and Consent (STRICT)

You agree to use the Service only for lawful purposes, such as:

  • monitoring your own device(s);

  • monitoring a minor child where you are the parent/legal guardian;

  • monitoring company-owned or company-managed devices for legitimate business purposes, with appropriate notice and policies;

  • lost-device recovery for devices you own/control.

You represent and warrant that, before any monitoring occurs, you have obtained all required:

  • device-owner permission, and

  • notice/consent required by applicable law and workplace policies, including where consent of one or all parties may be required for communications monitoring.

Prohibited Uses (examples):

  • stalking, harassment, intimidation, or domestic abuse;

  • monitoring a spouse/partner/employee/other individual without lawful authority and required notice/consent;

  • installing or using the Service on a device you do not own/control and are not authorized to manage;

  • using the Service to intercept communications unlawfully.

We may suspend/terminate accounts, refuse service, and cooperate with law enforcement if we suspect misuse.

5) Account Security

You are responsible for:

  • maintaining the confidentiality of credentials;

  • all activity under your account;

  • promptly notifying us of unauthorized access.

6) Installation, Permissions, and Device Settings

The Service may require permissions on the Monitored Device (e.g., location services, background activity, accessibility, notifications). Availability depends on OS/version and user settings. You are responsible for enabling only what you are authorized to collect.

7) Subscriptions, Billing, and Refunds

  • Certain features require a paid subscription.

  • Billing may be processed by third-party payment processors or app stores.

  • Subscriptions may auto-renew unless canceled before renewal.

  • Refunds (if offered): We may provide refunds only for verified technical failures within 7 days of purchase, subject to any overriding app store/payment processor rules and applicable law.

8) Acceptable Use Rules

You agree not to:

  • reverse engineer, decompile, or attempt to extract source code (except where prohibited by law);

  • bypass security features or access data you are not authorized to access;

  • use the Service to transmit malware or to interfere with networks/devices.

9) Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference.

10) Intellectual Property

The Service (including software, trademarks, logos, and content we provide) is owned by the Company or its licensors and is protected by IP laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for lawful purposes under these Terms.

11) Feedback

If you submit suggestions, you grant us a royalty-free, worldwide license to use them without restriction.

12) Suspension and Termination

We may suspend or terminate access immediately if:

  • you breach these Terms;

  • we reasonably suspect unlawful use or abuse; or

  • required by law.

You may stop using the Service at any time. Account deletion requests are handled per the Privacy Policy and subject to legal retention requirements.

13) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted, error-free operation or that monitoring data will always be complete/accurate.

No emergency services: PT247 is not a 911/emergency response service.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE ONE (1) MONTH BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF NONE, USD $50).

15) Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers/directors/employees from claims arising out of:

  • your use/misuse of the Service;

  • your violation of law or third-party rights;

  • your failure to obtain required notice/consent.

16) Dispute Resolution; Arbitration; Class Action Waiver (U.S.)

PLEASE READ CAREFULLY. THIS AFFECTS YOUR RIGHTS.
To the extent permitted by law, any dispute arising from these Terms or the Service will be resolved by binding arbitration on an individual basis, not in a class or representative action.

  • Either party may bring claims in small claims court if eligible.

  • Either party may seek injunctive relief in court to prevent misuse, unauthorized access, or IP infringement.

  • The Federal Arbitration Act governs this section.

17) Governing Law and Venue

Except where preempted by federal law (including the Federal Arbitration Act), these Terms are governed by the laws of the State of Texas, without regard to conflicts rules.

18) Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice (e.g., in-app or on our website). Continued use after the effective date means acceptance.
